The Arizona Court of Appeals ruled on Thursday that Lake, who claimed that intentional misconduct caused issues with ballot printers at some police stations on Election Day, had not provided any proof that voters whose ballots were unreadable by tabulators at polling places were unable to cast a ballot.

The court stated that even a witness invited by Lake to testify had agreed that votes could still be counted after ballots were initially unable to be scanned at polling stations.

However, the court rejected a pollster’s assertion that the issues at the polls had alienated enough voters to sway the outcome in Lake’s favor. The pollster had testified on behalf of Lake.

The evidence supports the finding that “voters were able to cast their ballots, that votes were tallied correctly, and that no other ground warrants throwing aside the election results,” the appeals court stated in its ruling that Lake’s appeal was unsuccessful.
